1. Acceptance of Terms

By creating an account or using Gapped, you agree to:

• Comply with these Terms of Service
• Follow our Privacy Policy
• Abide by all applicable laws and regulations
• Be at least 13 years of age (or the age of majority in your jurisdiction)

If you do not agree to these Terms, you may not use our services.

2. Account Registration

Account Creation

To use Gapped, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Take responsibility for all activities under your account

Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms.

3. User Roles and Responsibilities

Students

As a student, you agree to:

• Treat coaches with respect and professionalism
• Attend scheduled sessions or cancel with appropriate notice
• Pay for services as agreed
• Provide honest feedback and reviews

Coaches

As a coach, you agree to:

• Provide accurate information about your qualifications and experience
• Deliver coaching services as described in your listings
• Treat students with respect and professionalism
• Honor scheduled sessions or provide adequate notice for cancellations
• Comply with all applicable laws and regulations
• Not misrepresent your rank, achievements, or credentials

4. Payments and Fees

Payment Processing

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms and conditions.

Platform Fees

Gapped charges a platform fee on coaching sessions. The fee structure is:

• Coaches receive a percentage of the session price (typically 80%)
• Gapped retains the remaining percentage to maintain and improve the platform
• All fees are clearly disclosed before booking confirmation

Refunds and Cancellations

Our refund policy is as follows:

• Cancellations made 24+ hours before a session: Full refund
• Cancellations made less than 24 hours before: No refund (at coach's discretion)
• Coach no-shows or cancellations: Full refund
• Disputes should be reported to contact@gapped.gg

5. Content and Conduct

Prohibited Conduct

You may not:

• Harass, threaten, or abuse other users
• Post offensive, discriminatory, or inappropriate content
• Attempt to bypass payment systems or fees
• Share false or misleading information
• Impersonate others or create fake accounts
• Scrape, copy, or reverse-engineer the platform
• Use the platform for illegal activities
• Spam or send unsolicited messages

User-Generated Content

By posting content on Gapped (profiles, reviews, messages), you:

• Grant us a license to use, display, and distribute your content on the platform
• Represent that you own or have rights to the content
• Agree that we may remove content that violates these Terms

6. Intellectual Property

The Gapped platform, including its design, features, and content, is owned by Gapped LLC and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our platform or content
• Use our trademarks or branding without permission
• Create derivative works based on our platform

7. Communications

By using Gapped, you consent to receive emails regarding:

• Account verification and security
• Booking confirmations and session reminders
• Payment receipts and billing information
• Platform updates and announcements
• Messages from coaches or students
• Marketing communications (you may opt-out)

You can manage your email preferences in your account settings.

8. Limitation of Liability

To the maximum extent permitted by law:

• Gapped is provided "as is" without warranties of any kind
• We are not responsible for the quality, safety, or legality of coaching services
• We are not liable for disputes between coaches and students
• We are not responsible for third-party services (e.g., Stripe, game platforms)
• Our total liability is limited to the amount you paid us in the past 12 months

Some jurisdictions do not allow limitations on liability, so these may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Gapped LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another user
• Your content or conduct on the platform

10. Dispute Resolution

If you have a dispute with Gapped or another user:

1. Contact us first at contact@gapped.gg to resolve the issue informally
2. If informal resolution fails, disputes will be resolved through binding arbitration in Wyoming
3. You waive your right to participate in class action lawsuits

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date
• Notify you via email or platform notification
• Provide you the opportunity to review changes

Your continued use of Gapped after changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Harm other users or the platform
• Fail to pay amounts owed

Upon termination, you lose access to your account and any remaining balance may be forfeited.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
